These Terms & Conditions (“Terms”) govern your access to and use of the websites, software, educational content, and automated trading tools operated by Market Miners LLC (“Market Miners,” “we,” “us”). By creating an account, connecting a brokerage, or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract. You are responsible for complying with all laws and regulations that apply to you, including the rules of your brokerage.

2. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. Access is granted to you personally and may not be shared, resold, or transferred.

3. Brokerage Connections and Trade Authorization

The service may connect to your brokerage account through third-party providers. You authorize us to read account data and, where you enable it, to submit orders on your behalf according to the strategy settings you configure. You remain solely responsible for every order placed in your account, whether confirmed manually or placed automatically while automation is enabled. You may disable automation or disconnect your brokerage at any time.

We do not custody your funds or securities. Your brokerage remains the custodian and the final authority on order acceptance, margin, and settlement. Market data, quotes, and calculations displayed in the service may be delayed, incomplete, or inaccurate, and should not be relied upon as the sole basis for a trading decision.

4. Not Investment Advice

Market Miners LLC is not a registered investment adviser or broker-dealer. All content, alerts, signals, strategies, and software output are provided for educational and informational purposes only and do not constitute investment, tax, accounting, or legal advice, nor a recommendation to buy or sell any security. Trading involves substantial risk of loss and is not suitable for everyone. You should only risk capital you can afford to lose.

5. Purchases, Subscriptions, and Refunds

Subscription and product fees are charged to the payment method you provide, and subscriptions renew automatically until cancelled. Due to the nature of digital content, all payments are non-refundable. Subscriptions may be cancelled at any time and it is your sole responsibility to cancel before the renewal date. Fees are exclusive of taxes, levies, or duties, which are your responsibility.

6. Acceptable Use

You agree not to reverse engineer, scrape, resell, or redistribute the service or its content; not to interfere with the operation or security of the service; and not to use the service for any unlawful, manipulative, or abusive market activity.

7. Intellectual Property

All software, content, trademarks, and materials made available through the service are owned by Market Miners LLC or its licensors and are protected by intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable license to use them for your personal use only.

8. Termination of Access

Market Miners LLC reserves the right to terminate a user's access to all products and services purchased if the user violates these Terms, engages in fraudulent activity, fails to continue payments, initiates a chargeback or inquiry with their financial institution regarding any transaction with Market Miners LLC, or threatens legal action against Market Miners LLC or its affiliates. Termination may occur without prior notice and may result in forfeiture of payments made. Market Miners LLC reserves the right to pursue legal action to recover damages resulting from such violations.

9. Disclaimer of Warranties

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any strategy, signal, or automation will execute as intended.

10. Limitation of Liability

To the maximum extent permitted by law, Market Miners LLC will not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, or exemplary damages, including lost profits or trading losses, even if advised of the possibility of such damages. In no event will our total liability to any party exceed the greater of $100 or the amount you paid to Market Miners LLC for the product or service out of which the liability arose.

11. Indemnification

You agree to indemnify and hold harmless Market Miners LLC and its owners, officers, employees, and affiliates from any claims, losses, liabilities, and expenses arising out of your use of the service, your trading activity, or your violation of these Terms.

12. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the service will be resolved by binding arbitration on an individual basis. You and Market Miners LLC waive the right to a jury trial and to participate in a class action. These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules.

13. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated date. Continued use of the service after changes take effect constitutes acceptance.
